Bevin Administration Files Official Response to Attorney General’s Political Lawsuit Against SB 1515/25/2018 Gov. Matt Bevin’s legal team filed in Franklin Circuit Court yesterday their official response to Attorney General Andy Beshear’s political lawsuit against Senate Bill 151, Kentucky’s recently enacted pension reform law. SB 151, the Commonwealth’s most meaningful attempt to protect the pensions of Kentucky’s public workers and teachers, was passed by both houses of the General Assembly on March 29 and signed into law by Gov. Bevin on April 10. Less than 24 hours later, the ever-opportunistic AG Beshear brought suit against the measure. In a 95-page brief citing dozens of pertinent legal precedents, the Governor’s team answered point-by-point AG Beshear’s flimsy arguments and unsubstantiated factual allegations. “The ultimate question for this Court is whether it wants to move the Commonwealth backward in the direction of fiscal irresponsibility and insolvent pension systems,” noted the Bevin Administration brief, “or whether it wants to join the recent [national] trend of marching toward prosperity and solvent pension systems….” Gov. Bevin’s legal team implored the Court not to “turn its back” on Kentucky public employees and retirees, pointing out that a ruling against SB 151 “will only hasten the decline of the pension systems.” If AG Beshear’s lawsuit were to succeed, there would be significant detrimental consequences for those relying on pension checks from the Commonwealth. Future legislatures would not be legally bound to make full actuarially required contribution (ARC) payments to the Kentucky Teachers Retirement System (TRS) nor held to level-dollar funding requirements to ensure plan solvency—jeopardizing the retirement security of tens of thousands of Kentuckians. Despite claims to the contrary in his political road show across the state this spring, AG Beshear’s lawsuit does not even allege that a single provision of SB 151 violates the inviolable contract rights of a single current or retired teacher. Moving forward, new teachers will be placed into a hybrid cash balance plan—a change that the state teachers union's own actuary admitted may provide a better benefit than the current system. “It’s a shame that the Attorney General is more concerned with protecting his family legacy than looking out for the best interest of Kentucky’s hardworking public employees,” said Bevin spokesman Woody Maglinger. “After his father [Gov. Steve Beshear] spent eight years underfunding the pension system by billions of dollars, AG Beshear is now playing politics with an issue that is vital to the financial security of individual retirees and the Commonwealth as a whole.” Oral argument in this case before the Franklin County Circuit Court is set for June 7. 32 year old Kenneth Edward Vibbert, Jr., of Park City, was indicted on four counts: Possession Of Synthetic Drugs 2nd Or Subsequent Offense, Operating On A Suspended/Revoked Operator’s License, Failure To Wear Seatbelt and Rear License Plate Not Illuminated. 49 year old Rondall Dewayne Brents, of Horse Cave, was indicted on four counts: Trafficking In A Controlled Substance 1st Degree, Drug Paraphernalia, Careless Driving and Persistent Felony Offender. 37 year old Tonya Lynn Morgan, of Glasgow, was indicted on one count of Criminal Mischief 1stDegree. 53 year old Michael Terry Webb, of Glasgow, was indicted on three counts: Criminal Mischief 1st Degree, Leaving The Scene Of An Accident and Persistent Felony Offender. 45 year old Bonnie M. Vance, of Tompkinsville, was indicted on six counts of Criminal Possession Of A Forged Instrument and one count of Fraudulent Use Of A Credit Card. Story courtesy of www.wcluradio.som A Taylor County man has been indicted in connection with a two vehicle crash in November of 2017 that resulted in the death of a LaRue County woman. Monday, May 21st, the LaRue County Grand Jury in Hodgenville indicted 33 year old Matthew L. Howsden of Campbellsville on charges of murder, leaving the scene of an accident and failing to render aid. Its being alleged that Howsden was operating a 2013 Chevy Equinox S-U-V west bound on Highway 210 in LaRue County when it veered into the oncoming lane colliding with an east bound 2010 Nissan Altima driven by 28 year old Stephanie Jansen of Magnolia who was pronounced dead at the scene. It’s being alleged that Howsden fled the scene on foot. The accident happened shortly before 10 P.M. Eastern time the night of Saturday, November 18th, 2017.

Representatives from 45 companies who earned the prestigious Governor’s Safety and Health Award during the last year were in attendance to help celebrate Kentucky’s all-time low Injury and Illness Rate. “Our administration has been relentless in our efforts to make Kentucky attractive to job creators while also promoting workplace safety initiatives for the employees who keep Kentucky moving forward,” said Gov. Bevin. “Our hard work is evident in the state’s record-low workplace injury and illness rate, while also having a record-high number of Kentuckians working, and a record-high $9.2 billion in economic investment that was made in our state last year. An educated, healthy, and safe workforce is imperative to ensuring that our current record setting economic trajectory continues. I applaud the exemplary work of the 45 companies that were recognized at this year’s Safety and Health Conference.” “I am proud to report Kentucky once again set a record for workplace safety,” said Labor Secretary Derrick Ramsey. “In 2016, Kentucky’s workplace injury and illness rate dropped to 3.4 per 100 full-time employees. This marks the lowest rate ever for Kentucky and demonstrates the tremendous progress that has been made since the federal government began collecting this data in 1996, when Kentucky reported an incident rate of 8.4. Such an achievement is a tremendous credit to employers and employees who have embraced a culture of safety in their workplace, but it is important to remember that there is always more work to be done.” The Labor Cabinet’s Division of Occupational Safety & Health Education & Training leads the Cabinet’s proactive efforts to create safe and healthful workplace conditions, including overseeing a web-based training service called Etrain (KYSAFE.KY.GOV). This online training module offers a variety of safety and health training topics, certificates, and live and recorded webinars all at no cost. In addition to Etrain, the Cabinet provides free consultative services to employers across Kentucky on ways to increase workplace safety – including how to improve injury and illness rates. Services include free on-site consultations to all employers, as well as other compliance assistance, educational materials, and class-style training for all employers. Last year, the Division conducted 254 free on-site visits, or “consultative surveys,” for employers across Kentucky. As a result of these confidential surveys, employers corrected 1,790 serious conditions that could have affected up to 55,136 employees and could have resulted in enforcement penalties of up to $12,530,000. Just before 12:30pmCT, Sgt. Evan Burton made contact with Joey Stiltz, 39, of Jamestown and Dawn Sinclair, 41, of Russell Springs, KY who were in a 2001 Mercury car in the parking lot of the Fairview Plaza at the intersection of KY 80 & KY 910. Sgt. Burton’s investigation included utilizing his partner, K-9 Matt. Subsequently, a quantity of “crystal meth”, marijuana and drug paraphernalia items were found. Stiltz and Sinclair were both lodged in the Russell County Detention Center on charges of Trafficking in a Controlled Substance, Possession of a Controlled Substance, Possession of Marijuana and Possession of Drug Paraphernalia.
